The best thing to do is schedule an appointment for a property assessment. The Huurteam will stop by to assess the overdue maintenance. If the Huurteam identifies serious shortcomings, you can choose to authorize the Huurteam to initiate legal proceedings.
There are a large number of maintenance issues for which legal proceedings may be initiated with the Huurcommissie. During the property assessment, the Huurteam will determine if any serious shortcomings are present. Here are a few examples of neglected maintenance: mould, mildew, leakage, wood rot, uneven floors and any damages caused by these arrears.
Huurteam Utrecht and the Huurcommissie may not force the landlord to address the maintenance arrears. If overdue maintenance is identified, the Huurcommissie will rule that the rent must be reduced by a certain percentage until all shortcomings have been resolved. This rent reduction should motivate the landlord to conduct the necessary repairs; the rent will otherwise remain significantly reduced. The tenant is responsible for all small, day-to-day repairs such as repairs to the doorbell, door and window fasteners, unclogging drains and venting the CV. The landlord is responsible for the general property maintenance and the related utilities, such as roof repairs, outdoor paintwork (e.g. window frames) as well as the plumbing.
Small repairs must be simple enough that the tenant can simply address it him/herself, and these repairs cannot be too excessive in cost. If this is not the case, the landlord will be responsible for the repairs.
Use of built-in kitchen appliances is included in the rent. All repairs to these appliances, for example a defective built-in refrigerator, are the responsibility of the landlord.
The tenant must grant entry permission to the landlord so that the required maintenance or repairs can be conducted. The landlord is obligated, however, to first schedule an appointment for this purpose.
The tenant is responsible for repairs of damage which the tenant himself/herself caused. If the landlord conducts the small, daily repairs himself/herself, then the landlord is permitted to charge the tenant for the incurred costs as service costs.
